The deal.

Upswing estimates how much demand a video topic has and how crowded it already is, then writes title and idea suggestions from what is already working. It is a research tool. Every number it shows is an estimate built from public data, and the suggestions it writes are generated by a language model.

Nothing here is a prediction of how your video will perform. Upswing is currently in beta, which means features appear, change and get removed without notice.

Upswing uses YouTube API Services. By using Upswing, you agree to be bound by the YouTube Terms of Service.

Google’s handling of your data is described in the Google Privacy Policy, and you can remove Upswing’s access to your Google account at any time from your Google security settings.

You need a Google account to sign in, and you are responsible for what happens under yours. One person, one account. Do not share access, and tell us if you think someone else is using it.

Upswing is for people who make videos. Accounts may be limited or closed if the app is being used in a way that breaks these terms, breaks YouTube’s, or puts the service at risk for everyone else.

• Scrape, resell, or redistribute the data Upswing shows you, or run it as a service for other people.
• Automate access to the app, or try to work around the daily limits.
• Reverse engineer the scoring, or attempt to extract the underlying API responses.
• Use Upswing to break the YouTube Terms of Service or the YouTube API Services Terms.
• Attack, overload or interfere with the service, or attempt to reach data belonging to another account.

Titles and ideas are generated by a language model reading public video titles. They can be wrong, generic, repetitive, or already in use by somebody else. Check before you publish. You are responsible for anything you post based on what Upswing suggested.

Whatever you do with the suggestions is yours. JFL Network claims no ownership of your videos, titles, thumbnails or channel. Equally, nothing Upswing generates is guaranteed to be original, and it is not legal clearance for anything.

The topics you search and the channels you attach stay yours. Upswing stores them to run the app, as described in the privacy policy. Creating a share link publishes that one result to anyone who has the link, which is the point of the feature and worth remembering before you share a topic you would rather keep quiet.

Upswing is provided as is, with no guarantee that it works, stays up, or keeps doing what it does today. It depends on third party APIs with their own quotas and outages, and when one of them is down, the part of Upswing that needs it will be too. There is no uptime commitment and no support obligation.

Daily limits apply and can change without notice, because the underlying API quota is shared across everyone using the app.

To the fullest extent the law allows, JFL Network LLC is not liable for lost revenue, lost views, lost time, or any other loss arising from your use of Upswing or from a decision you made based on what it showed you. Total liability for any claim is limited to the amount you paid to use the service, which for a free beta is nothing.

You can stop using Upswing whenever you like, and email the address below to have your account and its data deleted. We may suspend or close an account that breaks these terms, and may discontinue the service entirely. If that happens, signed in users get notice in the app before the data goes.

These terms can change. The date at the top moves when they do, and continuing to use Upswing after a change means accepting the new version. A change that materially affects your rights is announced in the app.

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute goes to the state or federal courts located in Los Angeles County, California.
